1. Acceptance of Terms

By downloading, installing, or using Qashly, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App. We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.

2. Service Description

Qashly is an offline-first personal finance management application that provides:

• Transaction tracking and categorization
• Budget planning and monitoring
• Financial goal setting and tracking
• Investment portfolio management
• Bill and subscription tracking
• Tax planning tools
• Financial calculators and converters
• AI-powered features (voice and image transaction entry)
• Multi-project and multi-wallet support
• Comprehensive financial reports and analytics

The App operates primarily offline with all data stored locally on your device. Optional online features require explicit user action to activate.

3. User Accounts & Data Storage

Account Creation:

• You must be at least 18 years old to create an account
• Account creation is at your discretion
• Email address is used solely for login authentication
• We do not have access to your email or password - they are stored locally on your device
• You may create one account per person
• Guest mode is available for trial purposes without account creation

Important Data Storage Notice:

• ALL your financial data is stored ONLY on your device
• We have NO access to your account data or financial information
• Deleting the app will permanently delete ALL your data
• We are NOT responsible for any data loss, corruption, or recovery
• You are solely responsible for backing up your data if desired
• Device damage, loss, or theft may result in permanent data loss

Account Security:

• You are responsible for maintaining the confidentiality of your credentials
• PIN protection is available and recommended for additional security
• We cannot recover lost passwords or PINs as we don't have access to them
• Account recovery is not possible as data exists only on your device

4. Subscription & Payment Terms

Subscription Tiers:

• Free: Basic features with limited custom categories
• Premium: Enhanced features, more categories, AI transactions
• Pro: All features, unlimited categories, priority support

Payment Processing:

• All payments are processed securely through Stripe
• We do not store your credit card information
• Subscription fees are non-refundable unless required by law
• Prices may change with 30 days notice to existing subscribers
• Free trial periods, if offered, automatically convert to paid subscriptions unless cancelled

Billing:

• Subscriptions renew automatically until cancelled
• You can cancel anytime through your account settings
• Cancellation takes effect at the end of the current billing period
• Lifetime plans are one-time payments with no recurring charges

5. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer or modify the App
• Not use the App for any fraudulent or illegal activities
• Maintain the accuracy of your financial data
• Not share your account with others
• Not circumvent any feature limitations or subscription requirements
• Comply with all applicable laws and regulations

6. Acceptable Use Policy

You may not use Qashly to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Interfere with other users' access to the service
• Use automated systems to access the App
• Misrepresent your identity or affiliation

7. Intellectual Property

• All App content, features, and functionality are owned by Qashly Ltd
• The Qashly name, logo, and branding are our trademarks
• You may not copy, modify, or distribute our intellectual property
• Your financial data remains your property
• You grant us a limited license to process your data solely to provide the service
• Feedback and suggestions you provide become our property

8. Third-Party Services

The App may integrate with third-party services:

• OpenAI: Powers the AI assistant and receipt scanning. Using these features sends your financial data to OpenAI — see section 4 of the Privacy Policy for exactly what (optional)
• Stripe: For payment processing
• Currency APIs: For exchange rate data

These services have their own terms and privacy policies. We are not responsible for third-party services' actions or policies. Use of these features is optional and at your discretion.

9. Disclaimers & Data Responsibility

• No Financial Advice: Qashly is a tool for personal finance management. We do not provide financial, investment, tax, or legal advice
• Accuracy: While we strive for accuracy, we cannot guarantee the App is error-free or that calculations are always correct
• Availability: We do not guarantee uninterrupted access to online features
• Data Loss & Corruption: WE ARE NOT RESPONSIBLE for any data loss, corruption, or financial data issues. All data is stored locally on your device
• No Data Access: We cannot recover, restore, or access your data as it exists only on your device
• User Responsibility: You are solely responsible for your financial data accuracy, backup, and security

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not liable for decisions you make based on App information
• We are not responsible for third-party actions or services
• Some jurisdictions don't allow liability limitations, so these may not apply to you

11. Indemnification

You agree to indemnify and hold harmless Qashly Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws

12. Account & Subscription Management

Account Deletion (By You):

• You may delete your account at any time through the App settings
• Account deletion is permanent and cannot be undone
• All your data will be permanently deleted from your device
• We cannot delete your account as we don't have access to it
• Uninstalling the app will also delete all your data
• No refunds will be provided for unused subscription time

Subscription Suspension (By Us):

• We can only suspend your subscription, not your account or data
• We may suspend your subscription if you:
  • Violate these Terms
  • Engage in fraudulent payment activities
  • Fail to pay subscription fees
  • Attempt to circumvent subscription limitations
• Subscription suspension only affects premium features
• Your local data remains unaffected by subscription changes

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use after changes constitutes acceptance. If you disagree with changes, you should stop using the App and delete your account.

14. Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the United Kingdom. If any provision is found invalid, the remaining provisions shall continue in full force.

15. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Qashly Ltd
• Severability: If any provision is unenforceable, the rest remains valid
• No Waiver: Our failure to enforce any right doesn't constitute a waiver
• Assignment: You may not assign these Terms; we may assign them without restriction

16. Platform Analytics & Crash Reporting

• Apple and Google may collect crash reports and analytics
• These platform-level analytics are outside our control
• Crash reports help improve app stability but contain no financial data
• You can disable analytics in your device settings
• Platform analytics are governed by Apple/Google privacy policies
